OTTAWA (Reuters) - A Canadian who masturbated at a window in his house won his appeal against a conviction for indecency on Thursday after Canada’s top court ruled there was no evidence of intent to commit an indecent act, and a home was not a public place.
The Supreme Court of Canada noted that British Columbian, Daryl Clark, had agreed it was an indecent act to have masturbated “in an illuminated room near an uncovered window visible to neighbors.”
But Justice Morris Fish, writing the 9-0 decision, said such acts have to be done in public places to be a crime — and a home was not a public place. The law also says indecent acts are only crimes in every location if the person intends to give offense.
Oh, now, this isn’t the funny part at all. Nope. You see, the funny part has to do with the neighbors who called the coppers.
The woman said she spotted Clark while she was watching television with her two young daughters in their family room.
She alerted her husband, and the couple observed Clark from their darkened bedroom for 10 or 15 minutes — also using binoculars and a telescope — before summoning the police, who said the upper part of Clark’s body was visible from just below the navel.
OK… now you have it. Canada is soooo boring that you have to watch your neighbor masturbate for at least 10 minutes before doing something about it. With binoculars and a telescope.
Whoa…. I’m sorry, but there is just something wrong with those people. The only question is, what was the running commentary from these folks? That is just a little too tough to think about right now.

Ok my first thoughts are… how long was he “working” on this before they started their “viewing”? how long did he continue after they completed their show? Or did they watch him to completion? Did they include the kids in this “family” activity?? How disturbing is this anyhow?
Think about it, if you saw a potentially completely naked man in a window (ok now i know a few of my friend, if the guy had a chisel figure likely they would gawk for an infinite period of time.. and certainly would not be reporting it) so if you saw this naked guy.. would you glance and turn away.. or would pull up a chair and pull out the binoculars?? How sad is this??
Now in my mind i know most folks if they think of something or start to do something obviously stupid they stop.. what happened to that mechanism for these folks?
Another question, obviously they are voyers, so did they get charged for being peeping toms?? they should have!
So this totally makes me ill there are people out there like this, not shocked but i do hate to be reminded there are people this idiotic! sigh!
